These Seller and Service Provider Terms and Conditions govern the use of Seller Services by Sellers and Service Providers on the Platform and shall prevail over the General Terms of Use in the event of any conflict or inconsistency.

These terms establish the binding conditions under which access to and use of the Seller Services is permitted. By engaging with the Platform as a Seller or Service Provider, you unequivocally agree to comply with and be bound by these terms.

Defined Terms

All capitalized terms not expressly defined herein shall bear the same meanings ascribed to them in the General Terms of Use. Key definitions include:

  • Required Product & Service Information

    All mandatory data including descriptions, identifiers, delivery limitations, pricing, brand/model specs

  • Seller & Service Provider

    Any individual or business entity registered for marketing, selling, and delivering Products/Services

  • Delivery Mode

    Manner of Product delivery - either via shipment or Buyer self-pickup

  • Delivery Information

    Includes all pertinent data related to shipping and delivery timelines, estimated or guaranteed dispatch and arrival dates, and specifics impacting transaction fulfillment

  • Automoss Refund Policies

    The binding return, replacement, and refund procedures as publicly posted and maintained on the Platform

  • Waybill

    Consignment notes, labels, and associated shipping documentation with full shipment details

Registration Requirements

In order to access and utilize the Seller and Service Provider Services on the Platform, every Seller is strictly required to complete the registration process by creating a valid and verified Account.

  • Full legal name or registered business name
  • Physical business or residential address
  • Active contact number and valid email address
  • Goods and Services Tax Identification Number (GST No.)
  • Permanent Account Number (PAN No.)
  • Government-issued identity proof
  • Real-time Live Location data

Platform connects Buyers with verified and professional Sellers for pre-owned vehicle transactions, routine maintenance, urgent repairs, and premium enhancements across all vehicle types.

Platform Operations

Marketplace Access

Sellers are strictly required to list products for sale with complete, accurate, and up-to-date product information. All listings must include all mandatory product details, and it is the seller's responsibility to ensure this information remains truthful, precise, and regularly maintained.

Order Processing

autoMoss provides a robust platform that enables and governs the complete transaction lifecycle, including the sale, secure payment processing, return, exchange, and cancellation of products and services. All such activities are subject to strict policies and oversight to ensure compliance, accountability, and a seamless user experience.

Product Categories

Sellers are expected to accurately categorize their products and services in accordance with autoMoss's classification guidelines, ensuring optimal visibility and discoverability for buyers.

autoMoss reserves the exclusive right to review, reassign, or modify product categories at its sole discretion to maintain consistency and uphold quality standards. Misclassification may result in listing adjustments or removal.

Order Management

autoMoss facilitates smooth and transparent transactions by providing Sellers with all essential order details. This includes product specifications, shipping instructions, live location tracking, customer contact information, and the delivery address for on-site deliveries.

In cases where the buyer opts for self-pickup, autoMoss shares the seller's and service provider's shop location with the buyer to ensure a seamless and efficient handover.

Logistics Support

All logistics arrangements are solely managed by the Seller, who is required to provide complete and accurate delivery details to autoMoss for timely updates to the Buyer.

OTP Verification Protocol

To ensure secure and verified handovers, every delivery, return, and replacement must be authenticated through a unique OTP (One-Time Password) verification process. This protocol enhances trust, accountability, and transparency throughout the fulfillment journey.

Conditions of Listing

autoMoss reserves the exclusive right to delist, suspend, or remove any product or service listing from the platform at its sole discretion. This may occur in response to buyer complaints, policy violations, quality concerns, or any other reason deemed valid by autoMoss.

Seller & Service Provider Representations

By listing products or services on the autoMoss platform, all Sellers and Service Providers explicitly represent, warrant, and agree to the following:

  • Legal Ownership

    They are the legal owners or duly authorized resellers/providers of all listed products or services

  • Accurate Information

    All product/service information (titles, descriptions, pricing, specifications, availability) is truthful, complete, and kept consistently up to date

  • Price Parity

    Shall not offer the same products/services on more favourable terms (lower pricing, better warranties, promotional offers) through any other platform or sales channel

  • Legal Compliance

    Remain in full compliance with all applicable local, national, and international laws, regulations, and autoMoss operational/ethical policies

  • Post-Sale Accountability

    Bear full accountability for all post-sale actions: returns, replacements, refunds, service revisions, warranty fulfillment, and remedying any improper or low-quality products/services

Disclaimers

autoMoss functions solely as a digital marketplace and does not provide any guarantee regarding the quality, durability, fitness, value, or marketability of any product or service listed by Sellers or Service Providers.

Platform Role Clarification

autoMoss is NOT a party to any transaction between Buyers and Sellers or Service Providers, and shall not be held liable for any transaction-related issues.

autoMoss NOT Liable For:
  • Order non-fulfillment or partial delivery
  • Product or service defects, misrepresentation, or inaccuracies
  • Damages, delays, or losses occurring during fulfillment or execution
  • Any disputes, warranty claims, or legal conflicts arising from the transaction
Payment Terms
(A) Payment Disbursement

autoMoss shall disburse payments to Sellers through a designated Nodal Account within 3 to 7 business days from the date of receiving the final confirmation of successful transaction completion from the Buyer.

All disbursements will be made after deducting applicable charges, platform fees, commissions, penalties (if any), and any other dues payable to autoMoss according to Return, Cancellation & Refund policy.


(B) Payment Accuracy Responsibility

(C) Right of Set-Off

autoMoss retains the unconditional right to withhold, delay, or deduct any amount owed by the Seller and service provider to autoMoss from such payouts, including but not limited to:

  • • Outstanding fees
  • • Chargebacks
  • • Refunds
  • • Legal liabilities
  • • Breaches of platform policies

Sellers explicitly agree to this right of set-off and acknowledge that payment timelines may be adjusted based on dispute resolution or compliance verification, if required.


(D) Disputed Transactions

No Payment Settlement for Disputes

Payments settlement shall NOT be issued under any circumstances involving disputed transactions. All such amounts will be governed exclusively by the autoMoss Payment Protection Policy, designed to uphold fairness, transparency, and security for both sellers and buyers.

autoMoss reserves full authority to investigate, hold, or release disputed funds based on conclusive verification under its secure payment framework.

Seller Obligations

Sellers and Service Providers on the autoMoss platform are held to the highest standards of professionalism, accountability, and legal compliance. By operating on the platform, they agree to the following mandatory responsibilities and restrictions:

(a) Product & Service Accuracy

Sellers and Service Providers are solely responsible for ensuring that all product/service information is accurate, complete, and regularly updated. They are also responsible for:

  • Timely processing and dispatch of orders
  • Secure packaging
  • Proper post-sale support
  • Resolution of any buyer disputes

(b) Prohibited Direct Contact & Off-Platform Transactions
  • Collecting payments outside the platform
  • Soliciting business outside of autoMoss
  • Diverting or influencing transactions off-platform
  • Forcing the cancellation order through the buyer

Any attempt to bypass the platform's payment and communication systems is a severe violation and will result in account suspension, financial penalties, or legal action.


(c) Seller and Service Provider Liability

If a seller or service provider accepts an order beyond their expertise, capacity, or inventory availability, they assume sole responsibility for all resulting buyer losses and are obligated to recover and reimburse the full extent of those losses without delay.

  • Promptly notify the buyer
  • Provide a corrective plan
  • Resolve the issue to the buyer's satisfaction
  • Complete all remedies (refunds, replacements, service corrections) at own cost
Unethical or Illegal Conduct
(a) Order Cancellation & Buyer Mistreatment

Sellers and Service Providers must NOT place buyers in distress by:

  • Confirming and then refusing to fulfill orders
  • Delivering incorrect, substandard, or unauthorized products or services
  • Engaging in any form of harassment, negligence, or deceptive behavior

Cancellation Limits

Unjustified order cancellations by the Seller or Service Provider are limited to five (5) instances per calendar month. Any further cancellations without a valid cause will attract financial penalties, negative rating impact, or potential platform suspension.


(b) Order Acceptance Criteria

Sellers and Service Providers are required to verify order details, payment method, delivery mode, and product/service availability before accepting any order. Denial of an order prior to acceptance is permitted.

However, once accepted, the Seller or Service Provider is fully obligated to fulfill the order and is liable for any loss, damage, or discrepancy, including:

  • • Delivery of incorrect or substitute products/services
  • • Delivery failures or misrouting
  • • Damages incurred during the completion of the order

In such cases, Sellers and Service Providers shall bear full financial and legal responsibility, including buyer compensation, replacement, or refund.

Unboarding Process

autoMoss welcomes all categories of sellers and service providers operating within the automotive ecosystem, subject to a strict and thorough verification process.

Verification Process Includes:
  • Submission and validation of required documentation
  • Telephonic verification
  • Physical site inspection (if required)
  • Confirmation of business legitimacy and operational capability
  • Alignment with platform standards

autoMoss Retains Right to Reject/Suspend/Unboard For:
  • Incomplete, false, or unverifiable information provided during onboarding
  • Failure to meet platform standards, category-specific criteria, or legal compliance requirements
  • Receipt of buyer complaints, quality issues, or fraudulent behavior
  • Detection of suspicious activity, policy violations, or ethical breaches
  • Determination that seller/service provider's offerings do not serve platform interests
Selling Criteria & Fees

Commission-Free Platform (Default)

autoMoss operates as a commission-free platform by default for primary categories and brands, empowering Sellers and Service Providers to offer their products and services with maximum earning potential.

However, commissions may be imposed in cases where Sellers or Service Providers consistently receive poor buyer ratings, fail to meet performance standards, or breach platform policies. This is enforced to protect the buyer experience and maintain platform quality.


(a) Subscription-Based Selling

All Sellers and Service Providers are required to operate under an active autoMoss subscription plan, which determines the scope, visibility, and volume of their listings.

Subscription tiers define access to premium tools, listing capacity, promotional offers, and order handling privileges.


(b) Transaction & Cancellation Fees
  • Transaction Fee

    Applied to every successful transaction processed on the platform (covers payment gateway charges, operational costs, and system maintenance)

  • Cancellation Fee

    In cases of order cancellations initiated by the Seller or Service Provider without valid justification, a cancellation fee will be automatically deducted from their next payout settlement


(c) Platform-Generated Offers

autoMoss may generate exclusive promotional offers or discount opportunities for select products or services. Sellers and Service Providers may choose to accept or decline these offers at their own discretion.

Participation is optional but may boost visibility and conversions.

Free Listings

autoMoss provides a Free Listing Tier for new or trial users. Under this model, Sellers and Service Providers can list a limited number of products or services with basic visibility and access.

GST Liability Allocation
Seller GST Responsibilities

The entire responsibility for charging, collecting, depositing, and filing GST on all product sales rests exclusively with the respective Partner/Seller in accordance with applicable Indian GST laws and rules. This includes:

  • Charging and collecting GST on product sales
  • Depositing GST to appropriate authorities
  • Filing GST returns
  • Issuance of tax invoices
  • Statutory returns compliance

autoMoss GST Collection (Services Only)

autoMoss shall charge and collect GST only on all its service categories on consideration for services successfully rendered through the platform.

Where a Partner/Seller or Service Provider holds a valid GSTIN, AutoMoss shall issue tax-compliant invoices for such services so as to enable the availment of eligible input tax credit in accordance with Indian GST provisions.

Clear Demarcation

Nothing in this clause shall be construed as creating any obligation on AutoMoss to discharge GST liability on the underlying sale of MRP products by Partners/Sellers, and all such tax, compliance, and regulatory obligations in relation to product sales shall remain solely and exclusively with the concerned Partner/Seller.

Partner Competence Liability

Partners, Seller and Service Providers expressly acknowledge that if they undertake and perform any work, or deliver any product or service, beyond their proper knowledge or expertise, and such conduct results in any loss, damage, or injury to the customer or the customer's vehicle, they shall be solely and fully responsible.

Seller's Full Responsibility Includes:
  • Bear all losses, damages, costs, and expenses incurred by the customer
  • Indemnify the customer for all claims and liabilities
  • Make good all damages caused by incompetence
  • Accept full legal liability for negligence

Platform NOT Liable

AutoMoss, as an online intermediary platform, shall NOT be responsible or liable for, and shall not be deemed to have assumed, any risk, loss, damage, claim, or legal liability arising out of, or in connection with, any such acts, omissions, or deficiencies of the Partner, Seller or Service Provider, and all such liability shall rest exclusively with the concerned Partner or Service Provider.

Remedies

autoMoss may take corrective actions to maintain platform integrity, protect buyer interests, and ensure compliance with these Terms and Conditions.

Platform Remedies Include:
  • Product Delisting

    Removal of specific products or services from the platform

  • Account Suspension

    Temporary suspension of seller/service provider account

  • Account Termination

    Permanent removal from the platform

  • Financial Penalties

    Deductions from payouts for policy violations

  • Legal Action

    Cooperation with authorities for fraudulent or illegal activities
